Privacy policy

Lucky Coffee Machine Co., Ltd. (hereunder "the Company") follows the laws and conventions regarding privacy, recognizes the importance of protecting all private information used in the course of our business, and promise to act as described below.

1. Management Personal Information

  1. The Company has appointed persons responsible for the management of handling personal information, and these persons manage appropriately while preventing unintentional disclosure outside the Company.
  2. The Company employs information security policies including measures preventing illegal access and anti-virus systems to prevent the loss of, damage to and leakage of personal information.
  3. The Company educates employees in the proper handling of personal information in order to protect personal information.

2. Acquisition and Use of Personal Information

  1. When the Company collects personal information, it does so using open and appropriate methods according to the law. When the Company obtains personal information purposely, it will make clear what the information will be used for directly by document or via the Web page. However, if it is clear at the time the information is obtained what it is to be used for, we may decline to reiterate the purpose for collecting the information.
  2. The Company may use personal information to achieve the aims outlined below.

  3. For personal information obtained and stored prior to the enactment of the Personal Information Protection Act (prior to March 31, 2005), the Company will use for purposes as described above.
  4. In order to perform its work efficiently, the Company may request third parties to handle personal information. In this case, we shall select third-party companies that the Company has determined properly handles personal information, and the Company will contract with the third party regarding the handling of personal information and perform proper oversight.
  5. If the Company has obtained personal information and continues its business after a merger, dividing into separate companies, or transfer of operations, before continuing it will obtain the permission of the person, notify them, or use the information to achieve the aims publicized.
  6. There may be cases where personal information may be obtained and used for purposes not described above without prior permission, including legal obligations, protection of life, health or property, and cooperation with government agencies.

  3. The person responsible for managing personal information at the Company shall be responsible for the personal information in shared use situations.

4. Provision to Third Parties

The Company will not provide personal information to third parties except in the following cases.

  1. When permission is provided by the person whose information is to be provided.
  2. When provided to a business partner through appropriately overseen outsourcing provider in order to achieve the stated aim of collecting the information.
  3. When the information was collected with the aim of providing it to a third party and the aims, data items provided, method of provision, and address to request a halt to such provision is readily known or notified.
  4. When it is difficult to obtain the permission of the person, but provisions of the information is required to protect life, health, or property.
  5. When ordered to provide data according to law by courts or government agencies.
  6. When the Company provides personal information as part of the process of merger, separation into separate entities, or transfer of operations.

6. Enquiries Regarding the Release of Personal Information

  1. Refer to "Contact for enquiries regarding private information" for contact information if you or an agent wishes to view, modify or halt use of your personal information.
  2. At the time of the enquiry, please understand that we will ask for identification to confirm that you are the person concerned or a valid agent for the person.
  3. If any of the following apply, we may not be able to comply with your request.
    1. If we are unable to confirm that you are the person concerned or a valid agent.
    2. If you request disclosure, correction, addition, deletion, or a halt to use of information that is not personal information held by the Company.
    3. If a danger is presented to the life, health, property or rights and interests of the person or a third person by the disclosure of the personal information.
    4. If there is a danger of a significant impediment to the Company's business through the disclosure of the personal information held by us.
    5. If another law is transgressed through the disclosure of the personal information held by us.
    6. If a request is made to correct or add to personal information held by the Company and the change is deemed to be unnecessary due to the nature of use or if the request is not deemed to be true.
    7. If a request to delete or halt usage of personal information held by the Company is made but no procedural indiscretion is recognized in our handling of the data.
    8. If a request to halt use of personal information held by the Company is made, but halting use is deemed difficult and a different method can be found to protect the rights and interests of the person.
  4. If a request to disclose the personal information held by the Company is made by the person or an agent, we shall respond by mail. In this case we will invoice for the amount required for mailing our response.

7. Treatment of Personal Information Related to the Website

When you provide sensitive and confidential information to us through our websites, we use Secure Sockets Layer (SSL) encryption technology to prevent unauthorized access to your personal information by third parties. Please be aware that you may be unable to use sites using this technology due to your computer environment.
